Article 1: Definitions

In these Terms of Use, the words or expressions below, whether written in the singular or the plural, have the following meanings:

Article 2: Description of the service

"CARRELIBERTIN" is an online community platform reserved for adults, dedicated to private, non-commercial exchanges and encounters between consenting adults. The site provides Users with the ability to chat with each other and meet.
The site is strictly forbidden to minors and may not be used for professional, commercial or non-private purposes, nor for prostitution, soliciting, escorting or pimping. Any misuse of the site for such purposes is sanctioned by the immediate and definitive deletion of the account concerned, without notice or refund, and where applicable by a report to the competent authorities (see article 8 below).
The pages of the site may present information likely to shock the sensitivity of younger people; "CARRELIBERTIN" intends to reserve access to its site to adults only. The site is concerned with respecting the security and privacy of its Users and especially minors. That is why parents are invited to monitor the use made by their children of access to "CARRELIBERTIN" and, as their legal guardian, it is the parents' responsibility to determine which service is or is not appropriate for their child(ren) and to monitor their use of it.
Access to content of an explicit nature is further subject to the effective verification of the User's adulthood, under the conditions defined in Article 4 bis below.

Article 3: Acceptance of the Terms of Use

Any consultation, even partial, of the site or the elements (images, video..) composing it entails acceptance of these Terms of Use. The User declares that they have read and accepted these Terms of Use in force on the day of access to the site. The site reserves the right to modify at any time all or part of these Terms of Use. Therefore, it is the User's responsibility to regularly check updates to the Terms of Use. Any use by the User of the service offered by the site after an update of the Terms of Use constitutes full and complete acceptance of the new Terms of Use.

Article 4: Registration, access condition and rights of access to your data

To be a Member of the site, the User must be at least 18 years old in France or have the legal age of majority in their country of residence and must complete all required fields in the registration form. Access to content of an explicit nature is further subject to the effective verification of the User's adulthood, under the conditions defined in Article 4 bis below.

The site reserves the right to modify, block or delete a profile if the content of said profile does not comply with the Terms of Use, in order to guarantee better service to other Users. The User will be informed by any appropriate means, except in the event of a serious breach or urgency justifying immediate action.
In accordance with Regulation (EU) 2016/679 (GDPR) and French Data Protection Act No. 78-17 of 6 January 1978 as amended, the User has, with respect to their personal data, the right of access, rectification, erasure, restriction of processing, objection, portability and the right to withdraw consent at any time. These rights may be exercised via the contact form provided on the site, or by post to the registered office address. For more information, the User is invited to consult the privacy policy.
No personal data of the User is sold, rented or transferred to third parties for commercial purposes without the User's prior, free, specific, informed and unambiguous consent. The use of data for direct marketing or promotional communications by the site may only take place on the basis of express consent (opt-in) collected at registration or subsequently, which the User may withdraw at any time from their personal area or via the contact form.
Certain information, indications or content (photograph or video) that Members may provide on an optional basis may, under the responsibility of the Member concerned, reveal the Member's ethnic origin, nationality, religion and/or sexual orientation. Such data falls within the special categories of data referred to in Article 9 of the GDPR. The processing of such data by the site is subject to the Member's explicit and separate consent, collected at the time of input, in accordance with Article 9(2)(a) of the GDPR. The Member may withdraw such consent at any time by editing or deleting the corresponding information from their personal area.

Article 4 bis: Verification of adulthood and protection of minors

Registration on the site, as well as access to any content of an explicit nature, are strictly reserved for adults. In accordance with French Law No. 2024-449 of 21 May 2024 aimed at securing and regulating the digital space ("SREN Law") and with the technical reference framework of the French Audiovisual and Digital Communication Regulatory Authority (ARCOM) published pursuant to Article 23 of the Law for Confidence in the Digital Economy (LCEN), "CARRELIBERTIN" implements a reliable, compliant and privacy-respectful system for verifying adulthood, within the limits of current technological capabilities.

Deferred display of explicit content. No pornographic or sexually explicit content is displayed to the User before their adulthood has been verified according to the procedures described below. A mere declaration of adulthood is not sufficient to grant access to such content.

Use of an independent third-party provider. Verification of adulthood is carried out by a third-party provider that is legally and technically independent from "CARRELIBERTIN" and compliant with the technical requirements of the ARCOM reference framework in force. This provider applies the principle of double anonymity: it does not know for which service the verification is being carried out, and "CARRELIBERTIN" does not have access to the identity data used to verify age. As a strictly limited exception, where the gender declared on the profile can only be confirmed by means of an identity document (for example if this information does not appear clearly on the document), a one-off consistency check may be carried out, without access to any other personal data of the User.

Verification methods offered. The provider offers at least two distinct methods of generating proof of age (for example: verification of an official identity document, age estimation based on biometric features). The precise procedures and the choices offered to the User are described in the provider's terms of use, communicated at the time of verification.

Data processed and retention period. The data collected as part of the verification is processed exclusively by the third-party provider, in compliance with Regulation (EU) 2016/679 (GDPR) and with the principles of accuracy, proportionality and minimisation. It is retained by the provider for a maximum period of thirty (30) calendar days from the date of verification, then deleted securely in accordance with applicable standards. The process generates no reusable proof of age, in accordance with the double anonymity principle.

Information prior to payment. Before any subscription to a paid plan giving access to features linked to explicit content, the User is informed, in a clear and visible manner, that an age verification will be required in territories where regulations so require. Validation of the payment constitutes acknowledgement of this information and express acceptance of the use of the verification provider, in the following wording or equivalent: "You confirm that you have read and accepted the Terms of Use and have been informed that an age verification, required in your country, will be necessary to access explicit content."

Remedies in the event of failure or automated decision (Article 22 of the GDPR). In the event of a verification failure or disagreement with the decision rendered, the User has a right of recourse with the provider to contest the decision, request rectification of their information and seek human intervention, in accordance with Article 22 of the GDPR. The precise terms of this recourse are described in the provider's terms of use. "CARRELIBERTIN" relays on request any complaint brought to its attention via the contact form.

Evolution of the verification system. "CARRELIBERTIN" undertakes to evolve its verification system proactively, as available technological solutions improve, in order always to better comply with ARCOM recommendations and privacy protection principles.

Parental commitment. "CARRELIBERTIN" reminds parents and legal guardians that it is their responsibility to monitor their children's use of online services and to implement appropriate parental control tools, in particular those made freely available by Internet access providers and operating system manufacturers, in accordance with French Law No. 2022-300 of 2 March 2022 on strengthening parental control over means of access to the Internet.

Article 5: Accuracy of information provided

By registering on the site, you agree to provide accurate and complete information about yourself and to update it regularly. In the event that you provide false, inaccurate, outdated or incomplete information, the site will be entitled to modify, suspend or terminate your account and to immediately and in the future refuse access to all or part of the Service. By accepting these Terms of Use, the User therefore undertakes to correct their profile if their situation has changed, or, in the case of information they cannot modify, to notify the Site so it can make the necessary correction.

You are aware that all information and data of all kinds, whether made public via the site or partner sites or transmitted privately, are under the sole responsibility of the person who issued the content. You alone, and not the site, are entirely responsible for the content you display, send by email or transmit in any other way.
It is also recalled that the password allowing the User to access all or part of the Service is sensitive, personal and confidential data that is in no way disclosed on the site. Each Member is responsible for keeping this information secret and not communicating it to third parties. In the event of identity theft of their login credentials, the Member will be considered responsible. If the User thinks that another person has taken over their profile, they must change their password and may notify the site so that any measures can be taken.

Article 6: Liability of the site

Given the volume of information, the control of content transmitted via the service by the site can only be limited. Consequently, "CARRELIBERTIN" does not guarantee the truthfulness, probity or honesty of this content. In all circumstances, the site cannot be held responsible, in particular, for the content, for errors or omissions in any content, for any damage resulting from the use of any content displayed, transmitted by email or in any other way via the service. More generally, the site cannot be held responsible for any direct or indirect damage that may result from the use of or, conversely, the inability to use the service.

The site will also make all necessary efforts to guarantee an optimum quality of service. However, the User is aware that the constraints linked to the Internet do not allow service interruptions to be avoided. In addition, the site cannot be held liable for a malfunction or an impossibility of access attributable to the User's access provider, Internet network congestion, unsuitable equipment, in the event of site updates or maintenance. As a result, the User may not under any circumstances request a partial or full refund of their subscription, or the purchase of equipment so that the User can access the site's services.
The site does not guarantee that the service will function without interruptions or errors. The service may also suffer occasional breakdowns and certain programming errors may be caused by updates or by events beyond the site's control. In addition, changes, suspensions, interruptions or a degradation of the service may occur due to the User's poor understanding of computing, the Internet and the Service, defective or inadequate configuration and hardware, or the use of browsers incompatible with the service... The information, content and features of the service may be modified. The site may make such modifications at any time. As a result, the site reserves the right, at any time, to modify, temporarily interrupt or permanently interrupt all or part of the service, without prior notice to Users.

The site cannot be held responsible for the accuracy or inaccuracy and non-compliance with the Terms of Use by a User, in particular the information constituting Users' profiles. The site cannot be responsible, in any way, for any possible damage or harm, accidental or voluntary, that a User might complain of or suffer due to the behavior of another User with whom they have come into contact through the site.
The site cannot be held responsible for the dissemination of videos, images or sound of any kind on the site service by a User, namely, if the User distributes media, the site considers that the User is in compliance with the laws on the intellectual property of the artist(s) and the rights for the distribution of videos. Furthermore, the site cannot be held responsible for the possible consequences of the disclosure by the User of information, texts, content and images concerning them. By accepting these Terms of Use, the User expressly waives any recourse against the site on the basis of infringement of image rights, their honor, or their privacy resulting from the dissemination or disclosure of information concerning them as part of the use of the service made available by the site.

Users are advised to take all precautions during meetings, such as going to a public place and informing relatives of the place and time of the meetings. Users are also advised to be vigilant and to notify a moderator as soon as possible if the User notices a breach of the Terms of Use by another User.
In the event that the site's liability is sought concerning a User's non-compliance with the Terms of Use or the laws of the country, the User undertakes to indemnify the site against any conviction pronounced against it and will bear all costs that may be incurred.

Article 7: Controls carried out by the site

You acknowledge that the site may view content before and during its broadcasting. The site reserves the right, at its sole discretion, to refuse any content. Moreover, the site will be entitled to delete or remove any content that violates the terms hereof or is reprehensible in any other way. You acknowledge the site's right to terminate all or part of the access right corresponding to your account for any reason, notably due to lack of use, or if the site has good reasons to believe that you have violated or acted contrary to the spirit of these Terms of Use. You acknowledge that any termination of your access to the service under these terms may occur without prior formal notice, and you acknowledge and accept that the site will be entitled to deactivate or delete your account at any time with immediate effect and/or prohibit any further access to the service. In addition, you acknowledge that the site cannot be held liable to you or to third parties for any termination of your access to the service. You acknowledge and accept that if the site protects content, it may be required to disclose it to comply with applicable laws or if, in good faith, the site believes that such a measure is necessary in the context of legal proceedings, to enforce the terms of use of the service, to respond to complaints alleging infringement of third-party rights, to protect the rights or interests of the site, its Users or the public.

The site also carries out controls through moderators who reserve the right, at their sole discretion, to refuse any content in a profile, text or photo. In addition, moderators are entitled to delete, modify or remove any content from a profile that violates the Terms of Use or applicable law. Furthermore, moderators reserve the right, at their sole discretion, to ban a User who does not comply with the Terms of Use in the site chat, without prior notice and without any justification being given. By accepting these Terms of Use, the Member also acknowledges that moderators have the right to modify or delete any data concerning them and to access information not accessible to ordinary Users. Moderators are required to respect everyone's privacy and to use such prerogatives only for control purposes. In case of breach of this rule and if the facts are proven, the moderator's liability may be directly called into question; the moderator may then be removed or banned from the site. Users may report to the site (via the contact form provided) any abuse by a moderator; the site's liability cannot be engaged.

Article 7 bis: Reporting of illegal content and contact point (Regulation (EU) 2022/2065 - DSA)

In accordance with Regulation (EU) 2022/2065 of 19 October 2022 on a single market for digital services ("Digital Services Act" or "DSA"), "CARRELIBERTIN" provides its Users and third parties with an accessible and easy-to-use mechanism enabling them to notify the presence of any presumed illegal content hosted on the service.

Notification procedures (Article 16 DSA). Any individual or authority who considers that information or content disseminated on "CARRELIBERTIN" is illegal may submit a notification through the following channels:

To enable diligent processing, the notification must contain, in accordance with Article 16(2) DSA:

Acknowledgement of receipt and processing (Article 16(4) and (5) DSA). "CARRELIBERTIN" acknowledges receipt of the notification without delay and examines it diligently, in a non-arbitrary, non-discriminatory and objective manner. The decision rendered is notified to the person who submitted the notification, as well as to the author of the reported content when a measure is taken (deletion, restriction of visibility, suspension or deletion of the account, etc.), in accordance with Article 17 DSA on statement of reasons. This notification mentions the internal recourse available (see below), the possibility of bringing the matter before an out-of-court dispute settlement body certified under Article 21 DSA, and the competent courts.

Internal recourse against moderation measures (Article 20 DSA). A User whose content has been deleted or restricted, or whose account has been suspended, may contest this decision via the contact form, within a period of six (6) months from notification of the measure. Contestations are handled by means that are not exclusively automated and under the supervision of qualified personnel, within a reasonable time. If the contestation is well-founded, the measure taken is reversed without delay and the User is informed.

Trusted flaggers (Article 22 DSA). Notifications submitted by entities that have obtained the status of trusted flagger from the national Digital Services Coordinator (in France, ARCOM) are processed as a priority and without undue delay, in accordance with Article 22 DSA.

Child-pornography content and harm to minors. Any content presumed to constitute an offence covered by Articles 227-23 and 227-24 of the French Penal Code (dissemination of a child's image of a pornographic nature, endangering minors) is, irrespective of any notification, subject to immediate removal and transmitted without delay to the competent authorities via the PHAROS platform of the French Ministry of the Interior (internet-signalement.gouv.fr), in accordance with Article 6-1 LCEN and Articles 14 and 16 DSA.

Single contact point (Articles 11 and 12 DSA). The single contact point of "CARRELIBERTIN" for direct communications with the authorities of the Member States, the European Commission, the European Board for Digital Services on the one hand, and with Users on the other hand, is:

TISC MEDIAS — DSA Contact Point
10 parc Club du Millénaire, 1025 Rue Henri Becquerel 34000 Montpellier, France
Contact form
Languages of communication: French and English.

Communications addressed to the contact point in either of these languages are handled within a reasonable time.

Misuse of the notification mechanism (Article 23 DSA). "CARRELIBERTIN" reserves the right to suspend, for a reasonable period and after issuing a prior warning, the processing of notifications submitted by persons or entities frequently submitting manifestly unfounded notifications or complaints, as well as the accounts of Users who frequently post manifestly illegal content.

Transparency (Article 15 DSA). "CARRELIBERTIN" publishes, under the conditions and within the time limits provided for in Article 15 DSA, an annual transparency report on content moderation activities, including in particular the number of notifications received and their categorisation, the measures taken, the use of automated means and the average processing time.

Article 8: Users' commitments

Strict prohibition of any activity of prostitution, soliciting, escorting or pimping. "CARRELIBERTIN" is a community platform intended for exchanges between consenting adults in a private and non-commercial setting. Any use of the site for purposes of prostitution, active or passive soliciting, escorting, pimping, or for the offer or solicitation of paid sexual services or against any kind of benefit (money, gifts, travel, accommodation, material goods, etc.) is strictly prohibited and exposes its author to the immediate and definitive deletion of their account, without notice or refund, and to a report to the competent authorities in accordance with French Articles 225-4-1 et seq. (trafficking in human beings), 225-5 et seq. (pimping) and 611-1 of the Penal Code, and where applicable to Article L.421-4 of the Code on entry and residence of foreigners and the right of asylum.
Any username, photograph, video, public or private message, external link, pricing reference, external contact or appointment suggesting the practice of such activities will result in the immediate deletion of the account concerned. Users are invited to report any such behaviour via the mechanism provided in Article 7 bis.

By accepting these Terms of Use the User undertakes, in addition to the other rules set out in the other articles, to:

Article 9: Profile certification

A "certified profile" is a profile for which the Member has provided the site or a moderator with evidence attesting to the accuracy of the information on their profile. The certification process can be carried out by asking the persons concerned to appear in front of a webcam or to send original photos showing them. By accepting these Terms of Use, Members authorize the site or moderators to ask them to certify at any time, and acknowledge the site's right to delete their profile if they refuse to comply with this obligation.
It is also specified that a certification obtained is not indefinite: if the Member's situation has changed without them modifying their profile or informing the Site of this change, or if their behavior is not consistent with their profile, the certification may be removed and other changes or corrections may also be made to their profile.

Since certification only verifies the match between the characteristics declared in the profile and reality, Users acknowledge that certification is not a total guarantee of the accuracy and sincerity of the information, and that the site does not have the means to verify this information beyond the appearances given by the certified Member. In the event that this information proves to be false or misleading, the Site's liability cannot be engaged.

Article 10: Risks related to "offline" meetings

Users' attention is drawn to the risks inherent in any contact, in "real life", with people unknown or known only through online exchanges. They are recommended to exercise the greatest caution in such meetings. By registering on the site, the User acknowledges full responsibility for their interactions and offline behavior following connections made through the service with other Users.

Article 11: Termination / Unsubscription

Each Member may end their registration on the site at any time and without reason, by requesting the closure of their account from their personal area or via the contact form. The destruction of the account entails the definitive deletion of all associated data.
The site reserves the right to suspend, block or delete an account in the event of a serious and proven breach of these Terms of Use, without prior warning. In such a case, and subject to the right of withdrawal provided for in Article 17 and to applicable mandatory provisions, a User whose account is deleted for serious breach of the Terms of Use may not claim a refund of the sums paid in respect of the current subscription period.
If a Member is dissatisfied with the Services provided by the Site, they are expressly invited to cancel their account, request the deletion of their profile and to no longer use the Services that they do not consider to meet their expectations. The Member nevertheless has the possibility of sharing suggestions with the Site in order to improve the quality of its Services.

Article 12: Duty to alert

The site strives to ensure compliance with the principles set out in these Terms of Use. Given the extent of exchanges on the site, the risk of their violation cannot, however, be ruled out. If the Member witnesses non-compliance with the commitments referred to in these Terms of Use, the Member acknowledges that they have the duty to inform the site, which will act while respecting their anonymity.

Article 13: Subscription

Registration by creating a profile on the site is completely free. The use of certain services offered by the site may also be free or paid. If the User has not subscribed to any paid plan, they benefit from restricted access to the site. However, they may at any time subscribe to one of the plans offered by the site to use more features.
CARRELIBERTIN uses the secure payment solutions Paybox and Stripe.

Subscription cancellation. The Member may, at any time and at no cost other than those associated with the transmission of the cancellation, terminate their subscription from their personal area via the "Cancel my subscription" feature, accessible in a few clicks, in accordance with Article L.215-1-1 of the French Consumer Code introduced by Law No. 2022-1158 of 16 August 2022 (in force since 1 June 2023). This online cancellation procedure is permanently, freely and directly accessible. The Member may also delete their profile, which automatically cancels the current subscription.

Unless cancelled by the Member under the conditions above, the current subscription is automatically renewed by tacit renewal on the same pricing basis as the initial subscription, for successive periods of the same duration. Cancellation takes effect at the end of the current subscription period and, in any event, in accordance with Article L.215-1-1 of the French Consumer Code, no later than at the next renewal date following the cancellation request.

Information on tacit renewal (Articles L.215-1 to L.215-3 of the French Consumer Code). In accordance with Article L.215-1 of the French Consumer Code: "For service contracts concluded for a fixed term with a tacit renewal clause, the service provider shall inform the consumer in writing, by nominative letter or dedicated email, at the earliest three months and at the latest one month before the end of the period authorising the rejection of renewal, of the possibility of not renewing the contract that has been concluded with a tacit renewal clause. This information, provided in clear and understandable terms, mentions, in a clearly visible box, the deadline for non-renewal. When this information has not been sent in accordance with the provisions of the first paragraph, the consumer may terminate the contract free of charge, at any time from the date of renewal."

In accordance with Article L.215-3 of the French Consumer Code, these provisions apply to consumers and non-professionals.

Prices can be modified at any time by the site without prior notice, it being understood that the prices of current subscriptions cannot be modified. Users are reminded that subscribing or not to a paid service does not in any way remove the obligation to comply with the Terms of Use. Where applicable, a moderator may delete, modify or block a profile that does not comply with these Terms of Use without refund. In addition, the site is not responsible for Internet service interruptions or technical problems that would prevent the User from connecting or using the services; therefore the User cannot request a refund if the site were to cut or reduce services temporarily.

Article 14: Intellectual property

The trademarks, logos, graphics, photographs, animations, videos, texts and all multimedia content on the site are the exclusive intellectual property of the site or its partners and may not be reproduced, used or represented without the express authorization of the site or its partners, under penalty of legal action. The rights of use granted by the site to Users or visitors are strictly limited to access, downloading, printing, reproduction on any digital medium and use of these contents for private and personal use. Any other use is prohibited without the authorization of the site. It is prohibited in particular to modify, copy, reproduce, download, distribute, transmit, commercially exploit and/or distribute in any way the services, pages or computer codes of the elements making up the site.
The Member grants the site a license to use the intellectual property rights attached to the content they provide for distribution on the Site. This license includes in particular the right for the Site to reproduce, represent, adapt, translate, digitize and use, for the purposes of the Service, the content concerning the Member (information, images, videos, description, search criteria, etc.), on all or part of the Service and/or in electronic communications relating to the Service (notifications, e-mails, mobile applications, etc.). The Member expressly authorizes the Site to modify said content in order to comply with the graphic charter of the site or the other communication media referred to above, and/or to make them compatible with their technical performance or formats. These rights are granted worldwide and for the entire duration of these Terms of Use between the Member and the Site. Furthermore, the Member undertakes not to copy, reproduce or otherwise use content relating to other Members, except for the strict needs of using the Services for personal and private purposes.

Article 15: Entire agreement and severability

These Terms of Use constitute the entire agreement governing the relations between the Member and the Site. They cancel and replace all prior provisions not expressly referred to or annexed, and constitute the entirety of the rights and obligations of the Site and the Member relating to their subject matter.
If one or more provisions of these Terms of Use were declared null pursuant to a law, a regulation or a final decision of a competent court, the other provisions would retain their full force and scope, to the extent permitted by said decision. In addition, the failure by a Party to avail itself of a breach by the other Party of any of the provisions of these Terms of Use shall not be interpreted as a waiver on its part to avail itself of such a breach in the future.

Article 16: Technical requirements

Access to the Services requires suitable equipment and an Internet connection, as well as a recent web browser compatible with W3C standards. The Member is responsible for their equipment and must ensure that their configuration allows them to use the Services in good conditions. The Member may request assistance from the Site, which cannot, however, guarantee the success of such assistance.

Article 17: Right of withdrawal

In accordance with Articles L.221-18 and following of the French Consumer Code (transposing Directive 2011/83/EU on consumer rights), the User who is a consumer has a period of fourteen (14) days from the subscription to a Subscription to exercise their right of withdrawal, without having to give reasons or bear costs other than those provided for in Articles L.221-23 to L.221-25.

To exercise the right of withdrawal, the User must notify their decision unambiguously, before the end of the 14-day period, by any written means (email via the contact form, or postal mail to the address of the registered office) attaching the purchase invoice received at the time of subscription. The User may also use the model withdrawal form made available, although this is not mandatory.

In accordance with Article L.221-24 of the French Consumer Code, the User shall be reimbursed for all sums paid no later than fourteen (14) days from the date on which the site is informed of the decision to withdraw, using the same means of payment as used at the time of subscription, unless expressly agreed otherwise.

Exception to the right of withdrawal. In accordance with Article L.221-28, 1°, of the French Consumer Code, the right of withdrawal cannot be exercised for service contracts fully performed before the end of the withdrawal period and whose performance has begun after the consumer's prior express agreement and express waiver of their right of withdrawal. By requesting the immediate execution of the Service from the time of subscription (in particular access to the features of the Subscription), the User expressly acknowledges that their right of withdrawal can no longer be exercised once the Service has been fully performed.

Article 18: Applicable law, mediation and jurisdiction

These Terms of Use are governed, interpreted and applied in accordance with French law, the language of interpretation being the French language in the event of a dispute over the meaning of a term or a provision of these Terms of Use. Where the User is a consumer residing in another Member State of the European Union, the User nevertheless retains the benefit of any more favourable mandatory provisions afforded by the law of their country of habitual residence, in accordance with Regulation (EC) No. 593/2008 of 17 June 2008 ("Rome I").

Prior amicable settlement. In the event of a dispute with "CARRELIBERTIN", the consumer User is invited, prior to any contentious action, to submit their complaint via the contact form made available on the site, setting out the subject matter of the dispute and the relevant supporting documents. "CARRELIBERTIN" undertakes to acknowledge receipt of the complaint and to provide a reasoned response within a reasonable time.

Consumer mediation. In accordance with French Articles L.611-1 et seq. of the Consumer Code, and after a prior attempt at amicable settlement has remained unsuccessful, the consumer User may resort free of charge to a consumer mediator for the out-of-court settlement of any dispute relating to the performance of these Terms of Use. Referral to the mediator is admissible only if the User has previously sent a written complaint to "CARRELIBERTIN" and the complaint has not been resolved within a period of two (2) months. Recourse to mediation is free of charge for the User and does not entail any waiver of the right of recourse to the courts.

European Online Dispute Resolution Platform (ODR). In accordance with Regulation (EU) No. 524/2013, a consumer User residing in the European Union may also access the European Online Dispute Resolution Platform, available at: https://ec.europa.eu/consumers/odr.

Jurisdiction. In accordance with Article R.631-3 of the French Consumer Code, the consumer User may bring proceedings before, in addition to one of the territorially competent courts under the Code of Civil Procedure, the court of the place where they were domiciled at the time the contract was concluded or where the harmful event occurred.
Otherwise, and for disputes not involving a consumer, jurisdiction is granted to the Tribunal judiciaire of Montpellier (resulting from the merger of the Tribunal de Grande Instance and the Tribunal d'Instance, in force since 1 January 2020 pursuant to Law No. 2019-222 of 23 March 2019).
